Adestra Briefing. The Fax Preference Service
Since the 1st May 1999 under UK law, it is unlawful to send unsolicited sales and marketing faxes to individuals without prior permission. In practice, this is achieved by allowing companies to register their fax numbers on the Fax Preference Service call list if they do not wish to receive direct marketing faxes.
The Fax Preference Service was set up by the Direct Marketing Association (UK) Limited (DMA). The original legislation was introduced in May 1999. It has subsequently been updated and the relevant legislation is now the Privacy and Electronic (EC Directive) Regulations 2003.
The regulations require that companies comply with an Individual's request for suppression made to the central registration scheme no later than 28 days after the request was registered.
If you fax someone on the FPS list both the originator of the creative and the company you use to broadcast the communication will be liable to be fined. This fine is reputed to be £5,000 GBP for each party within the channel.
